Judge James Moody Jr. ignored issues of standing and subject matter jurisdiction, to accomodate a bank which had no contractual capacity. He issued summary judgment to a bank, while knowing there were material issues of fact requiring adjudication. He refused to provide his legal reasoning knowing he had none, ignored 200 years of established law, the Arkansas UCC- and it appears participated in fraud on the court. The entire country will soon know about his complicity, bias and incompetence. He has no way to justify his decision, his administrative game playing (failure to sign final orders), and will be held accountable in his personal capacity for deprivation of due process. It is fair to assume from his conduct that he is owned by the banks.

Judge Moody is a fine and decent judge. He had many years as a commercial litigator with a very good firm in Little Rock before being appointed to the bench by President Clinton in the mid-1990's. He is bright, fair, even-handed, and of a gentle temperament.
