I don't think comment 5770 is really from a criminal defense attorney. Imagine, complaining about State Court executions being held up for years. On mere constitutional grounds, no less!! What a shock. Sounds like another state court prosecutor who can't admit what they do.

This judge held up executions in Missouri because he didn't like the Missouri execution procedure. He ordered change after change to the process - delaying action for years. See 8th Circuit rebuke.

Outstanding Judge. Fair, even-handed, highly respected by the bar and hard working. The golf comments below are a cheap shot. Judge Gaitan has always been a dedicated public servant who strives to do the right thing. He is fair to both sides of a lawsuit and keeps control of his courtroom.

Excellent in trial. Very fair to attorneys and he tries to be even handed. Some lawyers complain that he is slow to rule on pretrial motions. Demanding on lawyers with time management at trial. Keeps a strict schedule during the course of a trial. Overall, a good judge.

In a criminal case, Judge Gaitan's rule of decision seemed to be "whatever gets the case over most quickly - I have a tee time!" The trial day was designed for his convenience, without regard for the jurors, attorneys or parties.
