I read the comments. When a judge with a reputation for barring jury trials is writing 75 page opinions on a rule 12 motion, there is a serious problem.

You have a bunch of non-judges with no jury experience throwing cases out to keep the sacred skull and bones cow from really working. Disgusting. Doesn't write as well as he thinks he does.

Uses Rules 12 and 56 as cudgels to prevent any case from evwr reaching and being decided by a jury. We can't have that now can we. Laughingly once stated that rule 56 'allegedly' didn't allow a judge to find facts.

In the words of Dante, abandon all hope, Ye plaintiffs who enter here. You are basically presenting your case to a defense firm. The best argument I've ever encountered for having not just judges but all any career clerk to disclose all conflicts of interest in a case based on their work histories.

As noted below by an earlier commenter, the bias in favor of corporate interests, and the government, is marked, obvious, and almost comical. Opinions have an air of not being written by him but clerks with no life or legal experience. Pretentious literary allusions (it's "legion" not "Legion" (unless there was a bizarre attempt to reference the New Testament)), make it worse.

Good time to retire.

Be prepared to have your Complaint micro-analyzed for three years or more. Fact pleading controls.

Basically makes Bleak House look like a rocket docket. Decisions are verbose and strewn with gratuitous, innumerable footnotes about irrelevancies such as President Ford and other tangents.

Had my first case with him as he is now sitting in Connecticut. Boy, the New York bar really lost something when Haight moved to CT. A fine judge and a real gentleman. It was a pleasure to be before him. A throw back to the days when more federal judges were like him. Now he's a gem in the midst of a bunch of crude politicos.

I tried a civil jury case before him a few years back. He would seem to have been sent from central casting as the perfect judge: scholarly, a gentleman to the core, diligent, always willing to listen to argument with an open mind. I found him to be slightly biased in favor of the defense, but still mostly even-handed. I will probably never try a case before a better judge.
