Magistrate Judge Fox is very unfair and he is PRO Goverment in Civil Rights cases even if the Government is MOSTLY wrong.

There are many good things to say about Magistrate Judge Fox, but punctuality is not one of them. A recent case in point: thirteen at liberty defendants and their lawyers appeared in magistrate's court at 2:15 p.m. for presentment on the complaint. All had worked out simple bail packages with the Government. An unrelated case was called first. At a little after 3 p.m., Magistrate Judge Fox left the bench without explanation. He did not return until approximately 6:40 p.m. During the approximately 3 1/2 hours that perhaps fifty people in the court-room waited (the defendants, their counsel, many family members, several agents, court personnel, and counsel in other cases), no explanation was offered for the delay and no hint was given as to when Magistrate Judge Fox would return. When he did return Magistrate Judge Fox conducted presentments for nine incarcerated defendants, most of whom were charged in separate cases. The thirteen-defendant case was not called until approximately 9 p.m. and did not conclude until approximately 9:45 p.m.

Judge Fox is arrogant and a defendant oriented judge. He destroyed a case by denying further discovery in favor of a defendant for judicial economy. Defendant had a medical emergency and was not available for a conference and would not take the call ex parte. When defendant made his miraculous recovery and we requested additional time to complete discovery, Judge Fox denied it and said we should have let him know there was a problem sooner...duh

judge fox is an absolutely evenhanded jurist. he does what is right as a matter of law, while also taking into account the plight of a defendant and the defendant's family. he is practical, and looks for a fair resolution. he is a model jurist. he has no temper, and respects both sides evenly. judge fox should be blessed to have many more healthy years on the bench serving the citizens of the sdny.

Extensive mediation that went on needlessly for several hours due to Fox's refusal to do or say anything other than convey portions of what the other side may have said without opinion, comment or any independent thoughts or input. Evidenced no energy or interest in a case that was by no means ordinary or boring. Very passive and utterly civil. Bland. Fair but very passive. All initiatives came from attorneys or clients, Fox was merely a sounding board who seemingly had no place to go and was willing to sit and listen and listen and listen.

I appeared before Judge Fox pro hac. My case was referred by stipulation for a settlement conference. The litigation was very contentious. Judge Fox had the patience of Job and stayed with us through the evening to effect a settlement. He has an excellent demeanor, is intelligent and is comfortably firm. He was better than many private mediators.

M.J. Kevin Nathaniel Fox was always prepared and always probed the weakest part of the argument. He displayed an even temper and let counsel make arguments. He always provided a quick yet thoughful decision. One of the best M.J.s in the SDNY.
