Judge Koh is an unimaginative and unimpressive judge who is more concerned with trivial issues than the big picture. She seems uninterested in anything outside her area of expertise.

She recently dismissed my 1983 action on statute of limitations grounds because it was not filed within one year of the date of the incident. The 2 year statute has been in effect for decades !

The parties in our class action reached a tentative settlement over a year ago which she preliminary approved and then denied final approval and completely changed her position on issues that she specifically approved during the preliminary approval. This has caused unreasonable delay and the matter is still not approved due to her scheduling issues. Unacceptable.

This Judge, in my opinion, should not be handling complex litigation. She has no knowledge regarding management of class actions and has not familiarized herself with the issues in our case.

This judge was very much pro-plaintiff in my trial. She bent over backwards to twist the facts to suit the plaintiff's position. She failed to deem matters automatically admitted when the plaintiff failed to respond to my RFAs, she excluded my witness at trial when we agreed to offer her for depo, and she yelled at me for asking the court's basis for denying my Rule 50 motion, to name a few things. Also, in another case involving the USPS that I witnessed, the defense attorney won all of his arguments (I believe S of L or immunity), but she refused to rule until he tried to settle with the P. She has had no trial experience before coming to the bench, and it shows.

This judge seems to be sincerely committed to litigants alleging violations of their civil and constitutional rights. She was able to refer to evidence submitted in the complaint — without looking — and took the time to conduct her own research prior to our hearing. She gave clear references to cases and laws that she considered when making a final judgement in a 42 U.S.C. 1983 case. She gave us the feeling that our complaint was honestly considered. The one thing that was difficult was standing in front of her. She does become irritated quickly and expresses those irritations rather openly. She also expresses understanding, but not quite as openly. I can't say I wouldn't say some of the things she has said to overly pushy lawyers in the course of the litigation.

Did not familiarize herself with the law or the case before the hearing. Continued a simple hearing for several months.
