Civil Litigation - Private

Rating:10.0
Comments:
Every time I have before him I have been massively impressed. My first appearance was a whistle blowing action, in which I represented a truck driver. He was then a Magistrate Judge. II was a fairly green lawyer with a small firm then and was up against a “blue chip,” large local firm. The issue arose then as to whether my Plaintiff client was entitled to a jury trial. Counsel argued this issue while in Chambers. Instead of Ordering counsel to submit briefs, Judge Moskowitz personally researched the issue on the spot, and determined my client was entitled to a jury trial. I have been before dozens of District Court judges, and have found none more fair, hard working and brilliant than Judge Moskowitz. Just be sure to fully prepared when you appear. He listens carefully, but does not tolerate ineptitude.

I just appeared before him on a summary judgment argument. He invited oral argument to "help him understand the issues," and clearly had an open mind. He was courteous to counsel, and obviously appreciates preparation.

Comments:
Judge Moskowitz is easily one of the brightest if not the brightest judge in the Southern District. He knows the law...PERIOD! As a defense attorney he'll give your client one hell of a trial but if he's convicted the appeal will be bulletproof. Be warned; he'll make you work for your client.

Civil Litigation - Private

Comment #: 5254
Rating:8.5
Comments:
Probably the smartest judge in the district. Unfortunately, he sometimes sees and focuses on issues the parties do not care about and are not pressing. While courteous, he sometimes does not respect attorneys' time - keeping them waiting while he attends to other matters. Excellent on evidence, and even-handed.

Comments:
We were in a complicated, high-profile case before him, and he was extremely good. Smart, informed, interested, and more than willing to work with the lawyers. Exceptional. (Admittedly, with all the press there, it'd be hard not to be. Still, he's got a good reputation generally as well.)

Excellent jurist. He personally reads your filings and is scholarly and thoughtful.

You may have to wait a while for your turn but if you want to have an engaging and challenging argument and courtroom experience you will enjoy and appreciate Judge Moskowitz.
