Civil Litigation - Govt.

Comments:
This judge should go to small claims court where he can do less damage to people's productive lives. Uses City resources as an extension of his staff to execute coercion on defenseless homeowners and ensures convicted City employees are released of all Civil monetary damages. Does not need standing to rule, deliberating harming innocent crime victims, not neutral. Heavily biased and refuses to recuse under major conflicts of interest. Has major ego issues that damage every case he touches. He will literally break the law, going out of his way to inflict the maximum harm to crime victims that have already been traumatized and harmed by thugs. He routinely abuses his position and power - he should be removed from the bench as soon as possible to save lawful families from judicial abuse.

He is Judge that has honor and cannot be bought off in the dime store. A man who stands for truth and honor, American style.

He helps people who deserve a fair shake. They broke the mold for exemplary judicial behavior when they made him. No wonder he's been in the court for so long.

I see the Chief Judge as a plaintiff and defendant. As a former law clerk, I can only say this is an awesome judge and awesome guy. Very fair and probably too lenient on the lazy adversary.

I consent to his jurisdiction every chance regardless of what side of the v. I am on.

This is one very capable, fair and learned magistrate judge who long ago should have been elevated to the district court, if not the Second Circuit. Unfortunately, the senator making the judicial recommendations feels that demographics and political expediency trump merit and quality. What a shame. We could have been graced with an even more competent district court had Judge Gold become an Article III judge. Shame on Schumer and his warped notions of judge shopping.

Took a matter on legal issues in a civil personal injury matter that he admittedly had no prior experience and hammered out a settlement in a courteous and efficient manner. Very smart, but not too full of himself. A pleasure to be before. my only criticism is that he seemed to side with one side, but that is somewhat to be expected in extracting the type of settlement he did.

He knows the law and is not afraid to apply it, even at the expense of contradicting the district judge. The only magistrate we will consent to have decide motions or try cases before.

I have had many civil matters before Judge Gold and, honestly, I think they should clone him! Very professional, fair, knowledgeable and sharp. Can be accommodating and flexible with unique circumstances when given a justifiable/legitimate reason. Be prepared and don't try to BS him.

Bright and personable. As long as you are making points and not repeating them, he listens to you and then rules. Very professional. Great chambers. Appreciates preparation. Can be short if he is pushed for time but otherwise a very nice man.

M.J. Gold seemed to get it into his head even before we appeared before him that the case was frivolous. I still don't know why. He was extemely protective of the government in a civil case, granting them stay after stay and affording them every benefit of the doubt. It was as if the Federal Rules were irrelevant-- everything was his discretion.

Only after we won the case did he change his attitude. Then he seemed to favor us.

On the other hand he was always very quick with rulings. (Several times he ruled even before he got our papers which were quite timely -- oops!).

He is smart, no question, but full of himself. God forbid you "interrupt" him, such as by answering his question. Once lectured my client that there really was no principal involved in a case-- a civil rights case-- and he should be happy with money. My client told him he was wrong-- God bless.

In short, I think he works hard, but in my experience, he is a punk.

Gets a bad rap because he is impatient with bad lawyers, and sometimes a bit sarcastic. He is in reality one of the smartest judges on the EDNY bench, including district judges. He also spends a lot of time helping and coaching young lawyers and students. Should've been elevated years ago.

I disagree with comment 1144. I've always seen Magistrate Gold treat litigants and attorneys with the utmost respect. I haven't noticed that he takes a preemptive view of cases. He may run a tight ship with discovery orders, but all-in-all he's a keeper.

Has the scholarship to decide complex issues but strives to avoid deciding even simple issues at all costs. Works the parties to settle from early on parsing out legal advice to the lawyer he thinks needs more leverage in the case. Not overly interested in justice.

My contact with Judge Gold has nearly always been positive. Yes, he can sometimes appear pre-emptive, but he's completely independent, down-to-earth, bright, and cuts through the crap. He actually listens to you on matters like bail and is not afraid to approve a realistic bail package, even if stridently opposed by the government.

He is one of the best magistrates I have been before and I have been before most if not all of them in the Eastern and Southern Districts. Plainitffs get a fair shot no matter who the defendant is.

bully, with no respect for seasoned professionals. Takes a preemptive view of the case, and if he's against you, you're dead meat - mandatory orders, impossible schedules, even sanctions threats.
