Jolting Joe DiClerico, came up through the ranks in the hard way. A state trial judge , then Chief judge of the State Superior Courts and then US District judge. He's now in Senior status. Do not let the simplicity of his manner fool you. Joe is quite a scholar with a good dosage of common sense. He can handle complex legal issues with ease, and can see through the litigants, lawyers, witnesses , and even other judges. He has seen and experienced it all. He has seen lying witnesses from law enforcement and defense side and does not tolerate it. He makes sure that due process is given and the case is tried with as much fairness as possible. If you're guilty, just come clean and Joe will do his best ; if not , then expect the hammer to drop. God help you if you lie in his courtroom! Too bad we don't get to see him as often.

Congenial and polite. Not easily flustered. Not a screamer. well prepared. Sticks to established federal law and is not very adventourous in his rulings. He is a very harsh sentencing judge. Bottom line - fair trial, if convicted heavy sentence.

DiClerico is personally opposed to the Fourth Amendment and its exclusionary rule. He has never suppressed evidence, and is another of those weak, Republican judges who just goes along with the government. In my case, corrupt state police wrote anonymous, crank letters to my ex-girlfriend to obtain a warrant to search my home and harass me. DiClerico ruled they had probable cause to suspect me and procure the warrant even though police committed the crime described in the warrant application. He is described by my law professor friend as "the most mealy-mouthed judge" ever come across.
In habeas corpus litigation, he flouts the rules of procedure to run inmates out of court without a hearing on fact-dependent claims.

Judge DiClerico is a gentleman, very courtly and respectful to counsel and parties. He always gives litigants all the due process he can. He is, however, the harshest sentencing judge in our court and often gives mid-range and high end sentences.
