Civil Litigation - Private

Comment #: CA54971
Rating:1.0
Comments:
[Redacted by Ed.] with substantial bias against plaintiff attorneys, that has been cited by numerous other attorneys here as well. There is blatant disregard for due process, the rules of court, and the law. This may have been a good judge decades ago, but I'm afraid it's time for him to retire. When your bias and inclination becomes this obvious, it's time to retire.

Civil Litigation - Private

Rating:Not Rated
Comments:
He's horrible. Fails to read papers, even the detailed tentative rulings compiled by his staff. No backbone or ability to rule properly on issues, including discovery and substantive motions.

Litigant

Comment #: CA34216
Rating:1.0
Comments:
Cross complaint denied, Motion to strike forgot to rule, 1st continuance denied, 2nd continuance denied, denies the need of discovery, pre deny any future motions and comment on the pending case inappropriately and addresses the litigants completely inappropriately encouraging home sales due to now/future rulings against them. Blatantly WRONG and total MISCONDUCT violating ethical codes of judges

I had a demurrer hearing in front of Judge Kralik. From his book in which he purports to be so grateful and thankful and humble, I had high hopes for him. However, I felt him to be terribly cantankerous and pro-defense, sustaining, out of a multi-count First Amended Complaint,2 causes of action WITHOUT leave to amend as to one of the defendants, sustaining WITH leave to amend 10 or so (I think) of the other COAs and overruling only 2 of the other COAs. Who is Draconian to sustain w/o leave to amend on a FAC? And on at least 4 or 5 COAs, his ground for sustaining WITH leave to amend was that they were "duplicative." I had my attorney argue that this is not a ground on which a demurrer may be sustained, and it was a violation of my right to plead in the alternative, but he refused to hear it. I was very disheartened because I thought Judge Kralik had a heart. Total abuse of discretion. My attorney had to talk me out of taking a writ. I can only hope I am wrong about him in the future as my case proceeds.

I have been a civil litigator for over 20 years. However, my experience with Judge Kralik was as a potential juror. From the perspective of a juror, Judge Kralik was great. He was hospitable and welcoming and didn't waste our time. In addition, he was clearly in charge in the court room but treated the lawyers and court room staff with respect. I would love to try a case in front of him.
