His rulings are completely injustices.

Judge Kest is not a knowelegable judge but simply acts as a extra proscutor in the room. An examination of his sentencing histroy shows a significant diasparity in how he sentences minorities and less affluent defendants. He is a judge with a view of CJS born form the days of mass incarciration and selective prosecutions and becomes claer in his rulings and courtroom tactics to try and intimidate and scare defendants into resolving mattters in away that is not just.

The man should not be a judge if he will not be fair to all who are before him. A judge's job is not to asssit the staet or the defense but to be fair and just to all, no matter what result that may lead you to.
"the means do not justify the end"

He is in my opion garbage. In a minor case he would not put off while I was a witness in a trial at a major case. Finally he put it off after been ordered to I am told by Chief Justice. After that he did not not even listen or look at evidence and just ruled against me. At first did not even give me a chance to present my case until after my demand.

Judge Kest is a really good judge. He is tough, and can sometimes rub lawyers the wrong way, but he is smart and works hard. He treats litigants fairly. He is more like a federal judge in his approach, procedures and rulings. Overall an excellent judge in civil.

Horrible, Marshall Kest coming from civil has little to no experience in criminal justice division. Kest is a loose canon. He over punishes and abuses his position and has no interest in being fair and using his position to make a difference. He is arrogant and thinks it's all about him. He has no respect for lawyers or his staff.

Horrible temperament. Arrogant and condescending. While he is bright, and understands the law he is infected with "robe fever" to such a degree that he should step down from the bench. He no longer understands that cases are not about him.

It is dishearten to have a person such as John Kest Marshall on the bench. He has demonstrated a total disregard for the Rule of Law and his incompetency has proven he does not give a damn about any truthfulness in our Justice system.

Judge Marshall knowingly aided Florida Mobster Alec Difrawi by denying JUSTICE to those Alec Difrawi dba Expand, Inc. sued over the years.

In the case of Alec Difrawi dba Three Star Media dba Expand Inc. dba Softrock, Inc., case # 2013-CA-004602-O vs Investigative Reporter Les Henderson, Judge John Kest Marshall is now the designated Judge that is handling Alec Difrawi lawsuits @ the 9th Circuit Courthouse.

From an outside observer, it appears like Judge Marshall is aiding Mr. Difrawi.

Most damaging evidence presented by Defendant Les Henderson to the Court including Alec difrawi past business practices of erecting websites to destroy his critics were consider non-admissible for whatever reasons or law the Judge could find.

These same evidence and exhibits were presented to the Federal Court - Middle District of Florida Case #6:2007cv01854 and Case # 6:2007cr1854, lawsuits filed by Alec Difrawi against Mr. Henderson and others. Federal Judge Karla R. Spauling and Judge Anne C. Conway reviewed the evidence presented by Mr. Henderson and dismissed Alec Difrawi lawsuit as bogus and frivolous.

Now Alec Difrawi feels untouchable because Judge John Kest Marshall and the legal system we turn to for justice are now the very ones protecting Alec Difrawi.

A very fair and very appropriate judge. He is the type of judge we should have in every division. Some people think he's overly strict, but in reality he treats people fairly, rules on matters, has reasonable rules for his division, and is smart. What more can you ask of a judge?
