To call minors “aggressors” is to ignore the law. They are considered below the age of consent for a reason — they are too young to exhibit appropriate judgment. This is why the responsibility and burden to act appropriately lies solely with the adult in the situation. The law does not permit the judge to consider them to be aggressors - only victims. This judge should not be in the bench. What a showing of gross incompetence. Absolutely disgusting.

This “judge” should be disrobed and disbarred. To call a 13 and 14 year old the “aggressors” in a sexual act with a 67 year old man is wrong. Legally, neither of the VICTIMS in the Soden case could even consent to such an act so giving this sexual predator a lighter sentence based on this is unconscionable.

There is a legal age of consent as well as minimum sentencing guidelines for a reason, a the Soden case is exactly that reason.
These 13- and 14-year-old girls are CHILDREN. I pray to God he doesn’t have daughters, but if so, I’d be interested to know if he thinks it would be fine for a 67-year-old man to sexually assault his 13-year-old daughter, you know, if she were the AGGRESSOR.

This so called judge needs to be removed. If he thinks a 13-year-old child is the aggressor when an adult man has sex with her, he shows appalling judgment.

Mr. Gibbens seems to be under the impression that 15 year olds girls can be the ‘aggressor’ in sexual abuse cases involving 67 year old men, and doles out sentences accordingly.
I’m an American citizen, and I think this is criminal. Are these the sort of judicious decisions we are expected to accept? Are these the sort of people who are charged with protecting our communities?
Shame on you, Mr. Gibbens. If it were up to me, you’d be out of a job you obviously were never qualified for.
This is not America. This is shameful.
