Comments:
The absolute most incompetent judge that I have appeared before in my 17 years of civil litigation practice within the federal and state courthouses of NY and NJ; I also served as a law clerk, as well, at the start of my legal career, so I do have experience working with judges directly. Both parties filed respective SJ motions in April 2023 and now, in September 2024, after emailing and phoning Judge Kathy King's chambers on several instances, neither SJ motion has been decided. This is incredible. How long does it take to decide that there is a genuine issue of material fact that warrants the denial of the respective motions and set the matter down for a trial date? This judge is absolutely unfit and I have no idea how she was appointed. She needs to be removed ASAP to protect the public.

I appeared in front of Judge King on several motions. She scheduled just one calendar call, and then proceeded to dismiss cases against anyone who was late. I was 15 minutes late due to illness, and found my case had already been dismissed. I spent two weeks on a motion to restore the case to the calendar. On the return date, I was one of approximately 85 attorneys whose cases had also been dismissed by Judge King. I'd never witnessed anything like this in my career. At the next court appearances, I checked the court rules and noticed she had changed from holding a single calendar call at 11 am to 2 calendar calls, as is customary in NYC courts.

I wasted several thousand dollars of billable time and worked myself into a state of complete exhaustion during a brutal heat wave, to make my motion to restore the case to the calendar, which was completely unnecessary.

After the case was restored to the calendar, it was rescheduled for arguments on the motions. On the return date, the judge's secretary announced that it was adjourning the matter because the court had lost all the motions. That necessitated my spending several hours in copying, collating and hand delivering my motion papers, then waiting two months to argue the case.

I lost the time spent in having to prepare twice for court, and the time having to pay for and replace the motions. I've never experienced this in my practice either.

She is an evenhanded judge. She has a well-run courtroom with an efficient staff. During trial there were no significant delays, other than waiting for the jurors to arrive, which amounted to no more than 10-15 minutes. I was able to try the case and her rulings were balanced.

Comments:
This judge presides poorly over her courtroom. She puts technical defects of form that are excusable over substance. She has little knowledge of either procedure or the law. She is not educated with regard to the facts or the law when hearing arguments. She lets the court attorney feed her ear so that she does not actually hear your argument. She interrupts or steers the argument to distract attorneys from making their argument. She clearly favors one party over another, usually the larger firm or larger client. She permits unusually lengthy delays in issuing decisions, so that your position is often made moot by an intervening event. If she didn't start more than an hour late every day, maybe this review would be different.

Comments:
Judge King is a fair balanced judge who allows attorneys to try their cases without inserting herself during the interrogation of witnesses.
Her evidentiary rulings were fair and her rulings on pre trial motion issues were balanced and well considered. She was flexible with the parties on scheduling trial dates and accommodating witnesses and attorney schedules. The only critique I have for this judge is the slow speed that of the trial before her. Overall though Judge King is a good, fair and impartial judge, a breath of fresh air in Brooklyn.

I am a civil defense attorney. I tried a case before her in Supreme Court where she was sitting as an acting Supreme Court judge. I found that she had the normal tendency to favor plaintiff exhibited by most judges in Brooklyn. With regard to examination of witnesses, she will allow you to make your point with a truculent witness and will not cut you off. I thought her evaluation of the case was reasonable. Overall, above average for this jurisdiction.
