Reversed yet again today the Appellate Division on a foreclosure case involving RPAPL 1304, which he has written editorials against in the New York Law Journal. How can a judge who is biased against a foreclosure law, which has been upheld time and again on appeal, be allowed to sit in a foreclosure part? What the hell is this?! A banana republic in Suffolk County?

After reviewing several of Justice Whelan's decisions in foreclosure cases (I don't have cases before him) I can't believe he's still allowed on the bench. This guy is off the hook. Overall I'm not impressed with Suffolk County's judicial system and I'm wondering what's really going on out there.

This judge refuses TRAVERSE HEARINGS. What all that are refused Traverse hearing need to go is to the police department. If not served IT IS CRIMINAL. Needs to be filed as criminal. You have the legal right to face your accurer.
We have no judges but apointmments

All these judges are paid off.

In reply to the previous poster, unfortunately Whelan will never change his pro-bank stance. He seems to hate borrowers. He has written law journal editorials against the same 1303 and 1304 RPAPL notices that he rules on daily. There was an attempt to remove him from the bench and it failed. So there he sits, smugly dispensing foreclosure judgments, one by one by one, during the worst health crisis in a century. See you at the auctions, bring your checkbook and your mask.

How satisfying it is when his biased decisions are reversed by the Appellate Division. You would think after so many reversals, he would finally start applying the law instead of creating ridiculous pro-bank arguments.

Fair and even-handed Justice. Will hold lender's feet to the fire if you have actual proof rather than just bare accusations. OTSC was rightfully denied because the attorney never moved to vacate the previous default. Will not allow litigants to ignore a case then engage in stalling tactics.

On 10/19/20, Justice Thomas Whelan has unbelievably openly defied Administrative Order 157-20 from New York State Chief Administrative Justice Lawrence Marks.

This order stated that in ALL foreclosure matters, there will be a status or settlement conference before proceeding at all, and the effects of Coronavirus on the borrower would be discussed, along with many other issues.

In the foreclosure case of Teachers Federal Credit Union v. Brian F. Husch, Index Number 617052/2018, Whelan refused to sign an Order to Show Cause, asking that a scheduled foreclosure auction be stopped in order for the status/settlement conference promise in Adminstrative Order 157-20 (dated July 23, 2020), be held. He flat out refused.

This is in the middle of the Coronavirus Pandemic. Guess Justice Whelan doesn't care what the Chief Justice thinks.

Judge Whelen is excellent. He allowed my client to see him on the last hour of the day and ruled fairly. He recommended that his case involving a release of petroleum cleaning fluids at residential address at 74 Hilltop Drive, Sound Beach, NY at Scott's Beach Community be reviewed by Eastern District of New York. One of the best judges ever.

How can Justice Whelan rule over a foreclosure court, when he has openly written an editorial for the NY Law Journal (easily found online) against the 1303 and 1304 RPAPL protections, amongst other laws, enacted after the 2008 crash to help borrowers? These are the laws of New York State, and a man ruling on them has written an editorial against them. How can this be?

Justice Whelan in Suffolk County is in charge of a foreclosure part which virtually never denie a Judgment of Foreclosure and Sale. Show me more than 5 he has denied, if they exist. Justice Whelan is pro-lender, anti-borrower. He seems to be there simply to clear the foreclosure docket in Suffolk, rights of the borrower out the window, and with each decision on Judgements of Foreclosure and Sale, he finds for the bank. The borrower protections put in place in 2009, specifically the 1303, 1304, and 1306 RPAPL notices, mean nothing to him and he routinely disregards them, as does his associate Justice Howard Heckman in another foreclosure part in Suffolk.

In a case where the home was purchased from Suffolk County as a town tax foreclosed property. He let a bank take it back to sell it. 10 years after the bank lost its rights to the home. In my opinion he is Biased and I influenced by a prejudice against a home owner. He does not follow the code which is his job and needs to be sued.

Justice Whelan harbors great disdain toward the disabled. The entire proceeding was filled with mocking disabilities in general and personally too. I was unable to appear but when I got the file I could NOT believe the sarcasm. It is disgusting that this is allowed and accepted- there is no accountability.

Would find a way to foreclose on a ham sandwich if a bank brought the action. Refuses to follow the RPAPL borrower protections of 1303 and 1304 put in place after the 2008 real estate crash. He even wrote an editorial against those laws, but still presides over a foreclosure court in Suffolk. Fox guarding the hen house.

if you walked into his courtroom with a satisfaction of plaintiff's mortgage, he would still find away to foreclose. Incredibly biased.

Judge Whelan is a wolf in sheeps clothes. He has demonstrated racial and religious bias against me and my client. He is spiteful and will smile in your face while stabbing you in the back.

He is not strong on the law and he harbors resentment that he will never advance within the court system due to his DWI and domestic abuse history.
