Civil Litigation - Private

Rating:1.5
Comments:
Quite possibly the worst living judge right now in the Commercial Division. He's 73 and is ill-tempered, volatile, inept, rude, and not very smart. And that's putting it kindly. He makes wild threats because he doesn't want to do his job and doesn't understand modern discovery. We all hope his clerks recommend that he retire. He has no business on the bench.

Comments:
The only that is important to this judge is clearing his calendar. I have had two cases torpedoed by him without any attempt to get to the merits. Both plaintiff and defense counsel agreed in the other case we had to get it out of his court room as he was insisting on a trial without proper discovery. We ultimately paid for arbitration as we could not count on reasonable court intervention

If you have a need to be nicely Judge Ostrager is not for you. Otherwise he is a great judge. Get over it.

Comments:
Jude O is very smart; just ask him! He formed an early opinion (without any evidence) and issued inappropriate discovery ruling based on his early prejudices of the case.

Comments:
He's a terrible judge. Doesn't care about the law, facts or papers. He picks a "winner" and sticks to it even in the face of overwhelming evidence. He literally heard testimony from witnesses and "interpreted" them as he wanted it, to fit with his decision, despite them not saying what he claimed they said.

Civil Litigation - Private

Comment #: NY9525
Rating:6.5
Comments:
For a former litigator, you would think he would treat lawyers more fairly. He is a cranky and somewhat stubborn judge. He sticks to what he pre-wrote even if the facts at the hearing reveal a different outcome. Despite ample evidence to the contrary of what he wanted to rule initially, he refused to hear or read the evidence and stuck to his initial decision. The best advice is to paper the record as best as possible so you have what to appeal. His primary goal is to move cases along and settle them, regardless if that's the fair outcome. Be wary of his clerk and support staff, they are just like him, short tempered and have little patience. Hope this helps.

Lazy.

Comments:
He's a nice old man, but his primary motivation seems to be getting a case settled, rather than justice. He noticeably tunes out counsel during oral argument and will simply read a pre-prepared bench memo from his law clerk after a motion is argued.
