One of my favorite trial or pretrial judges. I am sorry he is leaving the bench at the end of 2009. Really tries to do justice, which is rather unusual theses days. Very practical in his application of the law and rules of evidence. An all-around good guy.

Judge Tolub is a pleasant enough judge, with a decent grasp of the law, who has been on the bench too long and no longer seems to care much about getting it right. He goes through the motions but shows no interest in tackling the important issues if there is an easier (or more appeal-proof) way to get there. He also has a tendency to keep much of the pretrial case off the record -- it is difficult to get a court reporter at a motion argument -- and as a result the parties end up arguing about what the ruling actually was.

Does not put on airs and is polite to counsel. Perhaps cuts oral argument too short. Seems to be thoughtful and humane, has obviously been around the block a few times.
