Perhaps it's dementia, and perhaps it's a total lack of respect for the Law, but you don't want a judge who is this out to lunch and has no knowledge of the law. Scary.

judge holly fell asleep during civil litigation case.and then rushed the jury to make a decision .so he could go on vacation. he and made perfectly clear to the jury that they would have to come back in two weeks when he got back from vacation.

Judge Holly has a commanding presence in the courtroom. I have appeared before him twice. The first matter involved the compromise of a minor's claim following a binding UM auto injury award. The judge seemed knowledgeable and rendered a decision in conformity with the law and the facts. The second time I appeared before Judge Holly was at a mandatory settlement conference where I was defending on a breach of contract claim. I had limited defense options and thought that the judge might lean on me. Instead, he intelligently engaged in a brief discussion on the merits of the case with counsel and then sent us back to the hall where we settled. Overall, I had a favorable impression and felt that I was treated respectfully. I observed the judge during oral argument of a motion for summary judgment and thought he was listening to both sides and asked reasonable questions. You can keep this judge.

Judge Holly takes a lot of things under submission and rules at the end of 90 days. However, although he says little during argument what he says shows he is smart and listening. I think he is fair and would put up with the delays given his intelligence and fairness.

In the immortal words of Dean Yager to "Dr." Pete Venkman, Judge Holly "seems to regard [the bench] as some sort of dodge or hustle." His routine is to issue tentatives devoid of any analysis, say nothing during oral argument, and then take the matter under submission for 90 days, at which point he will likely just deny the motion. I've even seen him take this approach on Discovery Referees' recommended rulings where the work's been done for him. Whether this is because he's forgotten what the motion was about and needs to get it off his desk so he can get paid, and never really looked at it in the first place, is not clear. What is clear is that the judicial process is not being taken seriously in Department 42 in Stockton.

Judge Holly has a tendency to ignore the law and rule based on what he thinks is fair. His rulings, especially his tentatives, are devoid of any real legal analysis, just a "granted" or "denied" or "appearance required." I wish I knew if he was just that busy or just that lazy about being a judge and actually applying the law to the facts. I've been in front of more complex cases in smaller counties with judges who took more time to understand the law and applied it, not simply come to the conclusion regardless. Will be exercising challenges from now on knowing that there's no fair shake to be had.

Overall average trial judge but one of the better civil judges in this venue due to weak bench.
